We received the judgment from the court 1 month or so after the trial.
The case was a dispute over counterfeiting of a registered trademark, and there were 8 defendants in total, so the trial took a long time.
 
I met with my client twice and attended two court hearings. It took 10 months from the time the client was arrested to the time the court issued the first-instancel verdict.

 
Before the trial, we wrote a 10-page statement of defense for our client, defending from various aspects such as the degree of participation, pleading guilty and accepting punishment, first offense, danger to society, and family situation, to convince court to make a lighter sentence.

 
Finally, with our unremitting efforts, we reduced our client’s sentence by 3 months. Both our client and his family were very satisfied with our work, and they think there is no need to appeal.

The insight of this case is that the judge shows mercy to the descendants of martyrs, but the judge is less interested in the family poverty certificate, because almost all defendants can provide proof of poor family situation.

 
Note: In China, if the family situation is bad, the judge may sympathize with the defendant and adjust the sentence. If the wife is pregnant, the children are young, the parents are in poor health and need to be taken of, needs care, in meeting certain circumstances, the judge will give
a lighter sentence.
 
One interesting point in this case is that the lawyer of one of the defendants in this case, did not act very professional and always asked some leading questions, and the judge interrupted her several times.
By contrast, we were the most prepared. After we delivered our trial opinion, several of the defendant’s attorneys, told the judge that our representation prevailed.
