1. Question: Can I employ a foreign attorney to represent me in court in China if I am already familiar with one outside of China?

Reply: No. According to Chinese law, you can only appoint a Chinese national who is admitted to practise as a Chinese lawyer to take part in litigation in China.

2. Question: Can I employ a Chinese lawyer remotely since I won't be travelling to China?

Reply: Yes, we do provide online contracting. The contractual relationship will be established whenever the client instructs our law firm and we submit the contract, sealed by the law firm, to the client as soon as it takes effect.

3. Question: Is it possible to file for divorce at a Chinese embassy abroad?

Reply: Your divorce can also be finalised in the Chinese embassy that officiated at your wedding, if one exists. Both marriage and divorce must take place in the same Chinese embassy.

4. Question: What happens if my partner declines to get a divorce in China? What if I have visa issues and cannot travel to China to obtain a divorce?

Reply: The divorce proceedings must be attended by the husband and wife in person or by a representative that has been designated by them. If one party purposefully chooses not to appear, the court may order them to do so. Alternatively, the court may resolve the issue of one party's failure to appear by contacting that party and soliciting their input on the divorce, property division, and child support, which will be recorded in the transcript, followed by a default judgement.

5. Question: Do I need to file a new lawsuit in China if I have already filed one abroad?

Reply: If China has jurisdiction, it is still advisable to litigate in China because only Chinese courts have the authority to divide a couple's joint property if it is located there.

The process of applying for the recognition and enforcement of a foreign court judgement in a Chinese court is time-consuming, and a number of variables can affect the case's outcome, including whether the two countries have a bilateral agreement and whether the foreign judgment's content violates Chinese law or other international regulations.

6. Question: How to figure out the properties jointly owned by the couple or only owned by one party during a divorce?

Reply: The following properties incurred during the existence of marriage shall be jointly owned by both husband and wife:

1) wages and bonuses; Pay for labour services, such as wages, bonuses, and remuneration.

2) any income incurred from production, investment or management;

3) any income incurred from intellectual property;

4) any property inherited or bestowed, with the exception of any property owned by either party decided by the will or the gift contract;

5) other property that shall be jointly owned.

7. Question: Timing of divorce proceedings

Reply: If both parties are unable to attend at the Civil Affairs Bureau in person to file for divorce immediately, you must file for a contested divorce in court.

A divorce in China typically takes 3-6 months to litigate if there is no disagreement and both parties can agree on the divorce matters.

A disputed divorce in China would typically take between 6 months and 2 years to complete if both parties cannot agree on the divorce matters.

8. Question: What is the scope of the inheritance?

Reply: It is the personal property of the deceased. If the deceased had a spouse, the common property of the couple should be divided first and the remaining part belonging to the personal property of the deceased is inheritable as an inheritance.

9. Question: How do I inherit from the deceased's estate in China?

Reply: a. By registering the inheritance with the property registration department in China.

b.Inheritance by means of a notary public issuing a notarial certificate: apply to a notary public to confirm the heir's inheritance of the estate.

c.Inheritance by lawsuit. File a lawsuit with the court where the property is located and ask the court to confirm the ownership of the inheritance.
